The Rail and Marine Determinations Directorate (RMDD) of the Canadian Transportation Agency (Agency) requires the provision of an expert in commercial liability insurance to perform the following:
– Provide advisory services to support the 2024 launch of the new passenger railway third-party liability insurance adequacy regime;
– Develop and deliver virtual or in-person training on commercial transportation liability insurance, focusing on the railway insurance sector.

Mandatory requirements

  • minimum of five (5) years of experience, within the last ten (10) years, specifically providing expert insurance advisory services in the field of commercial passenger transportation, for either public and/or private sector clients;
  • minimum of two (2) demonstrated projects developing and delivering training and/or information sessions;
  • experience providing advisory and risk management services in commercial passenger transportation third-party liability insurance;
  • project experience in commercial railway passenger transportation third-party liability insurance;

General Tasks

  • Provide RMDD staff with expert commercial transportation third-party liability insurance advisory services during the launch of the new passenger railway adequacy regime;
  • Provide RMDD staff with virtual or in-person training on commercial transportation third-party liability insurance, with a primary focus on the railway insurance sector;
  • Review and familiarize with RMDD’s new methodology documentation, which includes previous consultant reports, risk methodology framework, analysis of risk factors and related data points, and limits analysis studies;
  • Advise on potential areas that may need amendments or enhancements in order to better meet industry best practices with respect to risk assessment and commercial insurance;
  • Advise RMDD on the interpretation of already-obtained limits analyses studies in the overall application of the new methodology;
  • Advise RMDD on using railway companies’ risk scores in combination with limits analyses to establish recommended levels of per occurrence liability coverage for the subject passenger railway companies;
  • Advise RMDD on communications with railway companies to address complex commercial insurance questions that may arise;
  • Assist RMDD with any other third-party liability insurance-related issues that may arise during the launch of the new regime to ensure a successful transition.
